Terms and Conditions

In these conditions of trade: Winning Windows, or we, means Winning Windows Pty. Ltd. trading as Winning Windows (Company No.110 617 671). The following terms and conditions constitute a contract between the customer and Winning Windows. By browsing or placing an order, we take it that you have accepted the following terms and conditions.   Secure online shopping Shopping with Winning Windows is done via the secure PayPal. Payments are not made on the Winning Windows website. For those who prefer not to use the internet, we accept phone orders with payment by VISA, MasterCard or direct deposit. Delivery details A flat delivery fee of $21.95 per total order applies, Australia only. We do not deliver outside Australia. Delivery is by courier with tracking. Deliveries to Western Australia, Northern Territory, South Australia, Queensland, all regional areas and PO/Locker Boxes may incur an additional charge to the transportation costs. We will advise you of any additional charges prior to despatching the order. Most ready made products are despatched within 3 - 15 working days, subject to stock availablity. Made to measure products require the specified making time in addition to delivery time. We will advise you at the time of order if a longer delivery time is expected due to stock availablity. If a delay is expected on a part order we can despatch available items when ready if the customer requests so, or cancel the order.   Orders are delivered by a transport carrier. We recommend that a delivery address will have someone to accept the order. If no-one is at the delivery address to accept the order, the carrier will either leave a card for re-delivery, or leave the order at the delivery address, at your responsibility, if you specify this. We provide tracking information with deliveries by courier. Unfortunetly we cannot arrange for you to be contacted prior to the delivery. We cannot deliver to a PO Box.   If a courier cannot deliver an order due to no access to the property and the item is returned to us, we may charge the additional freight charges we incur due to a failed delivery. Our goods fulfill the following conditions: . are free from defects and faults in materials and workmanship; . are or merchantable quality - our products will reach the level of quality given the price of the goods and the description that is provided with the goods; . are fit for purpose to the best knowledge of Winning Windows.   If our goods do not fulfil any of these conditions we will repair or exchange the goods or provide a refund, credit or exchange on the return of the goods. In such cases we will  pay the freight costs to and from the buyer. To be entitiled to a full refund, the buyer must return the goods within 7 days of the order delivery.     Exchange/Returns Winning Windows will not provide a refund or credit under the following circumstances: .If a customer changes their mind .If the goods are custom made and/or damaged due to: . misuse or abuse by the buyer . improper installation of the goods by the buyer . normal wear and tear of the goods . everyday exposure of materials and components to sunlight and the elements. All materials can lose their original condition after exposure to the sun and general use. Exchanges may be accepted if you contact us within 2 working days of delivery. Please contact us prior to returning goods to us for an exchange. You will receive a prompt reply to your request of exchange or return. A $35.00 handling fee will apply. Exchanged items must be in the original condition and returned in the original packaging and in a re-saleable condition.  We cannot accept returns for products which are not returned in their original condition and original packaging, or have been used.  If returned goods have been used, a further handling fee of 30% of the order value will apply. Used goods cannnot be re-sold as new by us. Any exchanges do not include the cost of all freight or postage charges. If our delivery charges exceed the standard charge of $21.95, our full freight charge will be deducted from the order refund value to the customer. If a payment has been made by credit card, a 1.5% surcharge will also apply to the refund amount. If a payment is made by Paypal, the Paypal charge will be deducted from the refund, being 3%. Order cancellation Ready made products An order can be cancelled prior to being processed. If payment is by Paypal, the Paypal fee charged to us will be deducted from the order value as Paypal does not refund their charge to us. Credit card payment will have a 1.5% credit card surcharge deducted.   Custom made products Order cancellations on custom made orders will be accepted within 1 working day of an order placement. Cancellation of custom made orders after this time, or when the order is being made, will not be accepted. Deposit monies will not be refunded. We also reserve the right to charge an additional 20% cancellation fee on an order value to cover our cost of goods and labour.   Measurements Curtains, blinds, rods and tracks will be made to the measurements and specifications provided by the customer. Winning Windows will not take responsibility for incorrect orders due to incorrect measurements and/or specifiactions provided by the customer.   Disclaimers Photos included in the Winning Windows website are for illustrative purposes only. As such, they are not offered as an exact representation of the blinds or curtains for sale.    Computer screens will display fabric colours differently. The actual colour may appear vary from the colour on the screen. Fabric swatches are available upon request.   Fabric colour variations Variations may occur between the fabric swatches  and the ready made products provided. This is due to changes in dye lots of the fabric from which ready made products are made and are within industry standands.  Variations in dye lot colours will also occur between batches of ready made curtains. For exact colour matches custom made curtains are recommended. Drop variations Variations may occur in the drop of ready made curtains, which are within industry standards. Ready made products are made to reflect the price point and are not made to the same exacting standards as custom made products. Winning Windows will not be liable for any damages of any kind arising from the use of this website, including, but limited to punitive, incidental, indirect, direct and consequential damages.
